Lawsuit accuses UCP Seguin of Greater Chicago of not paying workers OT

A class action lawsuit accuses UCP Seguin of Greater Chicago, a nonprofit supporting people with disabilities, of allegedly not paying workers overtime and other wages allegedly required by Illinois' minimum wage law.

The lead plaintiff, Miguel Mora, worked six-day weeks as an extended support specialist but was not paid overtime, said the suit, filed in Cook County Circuit Court.

"Plaintiff was paid for all hours worked at straight-time, at the same rate of $20.75 per hour," the suit states."Plaintiff was not paid a time-and-a-half wages rate for all of his hours worked in excess of forty hours per week."

The suit seeks to represent all UCP employees who were allegedly shorted overtime pay..

"Plaintiff’s claim is typical of the claims of the members of the Class he seeks to represent, because the factual and legal bases of Defendants’ liability to Plaintiff and the other members are the same, and because Defendants’ conduct has resulted in similar injuries to Plaintiff and to the Class," the suit states.

The suit seeks unpaid wages and statutory damages " including treble damages and 5% monthly interest," as established in Illinois law, plus attorney fees.

The plaintiff is represented by attorneys James R. Mata and Daniel I. Schlade, of Justicia Laboral LLC, of Chicago.
