CHICAGO – A driver has filed a negligence lawsuit against S & L Cartage, claiming that he was injured in a head-on collision with one of the company's drivers.
Plaintiff Stanislaw Bednarz filed a lawsuit in Cook County Circuit Court against Marvin Shuantel Miller and S & L Cartage Inc., citing allegations of negligence.
According to court documents, Bednarz claims that on February 17, 2022, he was driving north/northeast on Arsenal Road in Will County when Miller, driving a vehicle in the opposite direction, suddenly left his lane and collided with Bednarz's vehicle head-on. The lawsuit states that Miller is an employee of S & L Cartage and was driving the company's vehicle while carrying out his duties within the scope of his employment.
Bednarz alleges that Miller breached his duty to exercise ordinary care for the safety of others on the roadway and cites various forms of negligence, including driving too fast for conditions, failing to keep a proper lookout, and general carelessness. In a separate count, Bednarz also holds S & L Cartage responsible under the doctrine of respondeat superior and cites the company for negligent hiring.
Bednarz claims to have sustained personal injuries as a result of the defendants' negligence. He is seeking damages in an amount exceeding $50,000 for medical bills, physical and emotional pain, suffering, and lost wages, plus court costs and any other relief the court deems proper.
