Illinois driver files negligence lawsuit for severe injuries suffered in interstate collision

CHICAGO – An Illinois man has filed a lawsuit claiming that he was severely injured when his vehicle was struck by a semi truck that collided with another driver. 

Plaintiff Nicholas Sheffer filed a lawsuit in Cook County Circuit Court against defendants Reagen Atwood, Timothy Dave Boutte, Jr., and Kap Boutte Trucking LLC, citing allegations of negligence.

According to court documents, the complaint relates to a motor vehicle collision that occurred on November 29, 2021, on Interstate 355 in the Village of Downers Grove. Sheffer claims that he was traveling northbound on Interstate 355, when a collision occurred between Atwood's vehicle and Boutte's semi truck, which caused Boutte to also collide with Sheffer's vehicle.

Sheffer alleges that Atwood and Boutte, who was an employee of Kap Boutte Trucking and acting within the scope of his employment, were negligent in the operation of their vehicles and also cites driving at an unreasonable speed, failing to decrease speed when necessary, failing to keep a proper lookout, and other violations of traffic laws.

Sheffer claims that he was severely injured in the accident and is seeking damages in excess of $75,000 for loss of normal life, loss of earning capacity, pain, suffering, mental anguish, and medical expenses, plus court costs and any other relief the court deems proper.
