Bruer and Buckley Obtain Defense Verdict in Medical Malpractice Case

Swanson, Martin & Bell, LLP attorneys Elizabeth A. Bruer and Shannon E. Buckley secured a defense verdict at trial on behalf of their client, a prominent hospital, in the Circuit Court of Cook County, Illinois.

In this case, the plaintiff alleged that the defendant’s emergency room (ER) nurses failed to thoroughly complete a triage history and neglected to expedite the transfer of the 7-year-old patient to be seen by ER doctors, resulting in the patient’s cardiac arrest, and later death, 1 hour and 16 minutes after arriving at the ER. At trial, Bruer and Buckley highlighted their defense experts, who opined that the child died of severe myocarditis that could not have been suspected, diagnosed, or treated before the child went into sudden cardiac arrest. 

Plaintiff asked the jury for $4 million – $7 million. After an hour and a half of deliberations, the jury returned a verdict for the defense. The case was tried before Judge Bridget Hughes.
