CHICAGO – A driver has filed a lawsuit claiming that he was injured when another driver backed out of a driveway directly into the path of his vehicle and caused a collision on South Menard Avenue in Chicago.
According to a lawsuit filed in Cook County Circuit Court, the plaintiff, David Padilla, claims that he was driving southbound on West 7800 South Menard Avenue when the defendant, Tomasz Cachro, allegedly backed out of a driveway directly into the path of Padilla's vehicle and caused a collision.
Cachro is accused of several acts of negligence, including failing to keep a proper lookout, failing to yield the right of way, not checking his mirrors while backing up, backing his vehicle into another vehicle, failing to wait for southbound traffic to clear, and being distracted.
Padilla claims that he suffered serious and permanent injuries as a result of the collision. He is seeking a judgment in excess of $50,000 for pain, suffering, lost wages, loss of normal life, and medical expenses, plus court costs and any other relief the court deems proper.
