FedEx contractor Northwest Express accused of allegedly wrongly scanning workers' faces

Northwest Express, a FedEx contractor, has been accused of violating Illinois' biometrics privacy law by allegedly improperly scanning drivers' faces. 

The class action lawsuit was filed on behalf of named plaintiff Thomas Stankus and other drivers allegedly similarly affected.

According to the complaint, Northwest Express illegally collected, stored, and used the biometric identifiers and information of its drivers without obtaining informed written consent, which allegedly is a violation of the Illinois Biometric Information Privacy Act (BIPA). 

The lawsuit is one of the most recent class actions brought against Illinois employees under the BIPA law.

The stringent law has been used to target thousands of Illinois businesses, typically extracting millions of dollars in settlement, after recent decisions by the Illinois Supreme Court left most employers all but powerless to defend themselves against BIPA-related lawsuits that accuse them of technical violations of the law, but no actual harm suffered by any plaintiff.

The plaintiffs in the new action are represented by attorney Michael Fradin, of Skokie.
