Class action: Debt collector Zwicker allegedly misled consumers facing lawsuits into default judgments

A class action lawsuit has been filed against debt collection firm Zwicker & Associates P.C., accusing the company of allegedly misleading debtors who are being sued in small claims court into uncontested default judgments. 

The plaintiffs, Greg J. Roth and Nicole Bolton, allege that the firm engaged in unfair, illegal, and dishonest debt collection practices.

They claim that the summonses served on them did not state a return date or require an appearance within 30 days, leaving them unclear about what action to take. 

The lawsuit further alleges that this practice is regular for Zwicker & Associates, based on a random sampling of summonses in their cases. 

The case was filed in Cook County Circuit Court on Dec. 4 by attorneys Daniel A. Edelman, Dulijaza (Julie) Clark and Matthew J. Goldstein, of the firm of Edleman Combs Latturner & Goodwin, of Chicago.
