CHICAGO – A woman has filed a negligence lawsuit against a driver following a rear-end collision at the intersection of York Road Avenue and Thorndale Avenue in Chicago.
According to court documents filed in Cook County Circuit Court, on June 22, 2023, the plaintiff, Halyna Petrakh, was waiting to make a turn in the right-hand southbound lane of York Road Avenue near the intersection of Thorndale Avenue when her vehicle was suddenly struck from behind by a vehicle driven by the defendant, Jose Navar, who allegedly failed to stop at the intersection in time.
Navar is accused of several acts of negligence, including failing to keep a proper lookout, failing to decrease speed to avoid a collision, failing to equip his vehicle with properly working brakes, failing to give an audible warning of a collision, operating his vehicle at a speed greater than reasonable for conditions, and general carelessness.
Petrakh claims to have sustained personal and pecuniary injuries as a result of Navar's negligence. She is seeking damages in excess of $50,000.
