CHICAGO — A pedestrian is suing for damages, claiming that he was crossing Madison St. in Skokie when a driver allegedly drove into him.
According to a complaint filed in the Circuit Court of Cook County, on Jan. 11, 2022, plaintiff Osi Atkins was a pedestrian near 4756 W. Madison St. in the city of Skokie. Atkins claims that as he was crossing the street, he was struck by a vehicle that was driven by defendant Lena Khamoo-Marcus, who was acting as an authorized agent and in the scope of her agency for defendant Danny Marcus.
The defendants are accused of several acts of negligence, including failure to maintain a safe distance from the vehicle immediately in her path of travel, failure to decrease speed to avoid collision, failure to keep her vehicle under control, failure to take evasive action to avoid collision, failure to yield the right of way, failure to warn Atkins by honking her horn, traveling at a speed greater than reasonable for conditions, making an unsafe lane change, and operating her vehicle while distracted.
Atkins claims to have sustained external injuries due to the defendants' negligence. He is seeking damages in excess of $50,000 for pain, suffering, mental anguish, disability, disfigurement, property damage, and medical expenses, plus court costs.
