Class action accuses debt collector Sequium of violating federal law in communicating with collection targets

Debt collector Sequium Asset Solutions is facing a class action lawsuit accusing the company of allegedly violating federal and state law in the way that it communicates with debtors targeted in collection actions.

The lawsuit was filed Jan. 5 in Cook County Circuit Court by attorneys Stacy M. Bardo, David J. Philipps, Mary E. Philipps and Angie K. Robertson, of the firm of Philipps & Philipps, of Palos Hills. The lawsuit was filed on behalf of named plaintiff Ramesh Marlecha and others allegedly similarly affected. 

The suit alleges that Sequium violated the Fair Debt Collection Practices Act (FDCPA) and the Illinois Collection Agency Act (ICAA) in its attempts to collect unpaid bills from customers. In the case of Marlecha, the lawsuit asserts the debt collector's emails allegedly never included required notices informing debtors of their rights to dispute the debt.

Marlecha claimed he never incurred the debt owed to a cell phone company that Sequium allegedly claimed he owed.

Marlecha is seeking unspecified actual damages and statutory damages, plus attorney fees.
