Driver sues CTA for negligence after bus driver allegedly collided with her vehicle during lane change

CHICAGO — A woman has filed a lawsuit against the Chicago Transit Authority, claiming that she was injured in a vehicle collision with one of the company's buses.

According to a complaint filed in Cook County Circuit Court, on Jan. 27, 2023, plaintiff Grace Dada was traveling southbound at 6620 S. Martin Luther King Drive in Chicago when her vehicle was struck by a Chicago Transit Authority (CTA) bus that was being driven by CTA employee Elizabeth Balbuena

Defendants Balbuena and CTA are accused of several acts of negligence, including improper operation of the vehicle, incorrect lane change, failure to equip said motor vehicle with adequate brakes, failure to stop or slow down the vehicle when danger was imminent, failure to provide proper warning, failure to keep a proper lookout, and negligently or carelessly causing a collision.

Dada claims that she was injured as a result of the accident. She is seeking damages in excess of $50,000 for pain, suffering, emotional distress, disability, disfigurement, loss of normal life, medical bills, plus court costs, and any other relief the court deems proper.

The plaintiff is represented by attorney Brian C. Hercule of the Law Offices of John S. Eliasik in Chicago.
