Trucking company sued after driver allegedly ran red light and injured Uber passenger in vehicle collision

CHICAGO — An Uber passenger has filed a lawsuit against a trucking company, claiming that one of the company's driver's ran a red light and caused a vehicle collision on 51st Street in Chicago.

According to a complaint filed in Cook County Circuit Court, on Jan. 7, 2022, plaintiff Marshall Bonds was an Uber passenger in Darius Melchor's vehicle. Bonds claims that while he was traveling eastbound on 51st Street in Chicago, a collision occurred between Melchor's vehicle and a semi-truck that was being driven by an unknown driver. The unknown driver was allegedly an employee of defendant Hunt JB Transport Services, Inc., and was driving the company's truck to deliver goods within the scope of his employment. The unknown driver allegedly failed to yield at a red light, turned eastbound on 51st Street, and struck Melchor's vehicle.

The unknown driver is accused of various acts of negligence, including failing to exercise care and caution typical of a reasonable person, driving at excessive speed, failing to stop their vehicle in time to avoid a collision, failing to obey a red traffic control signal, failing to yield right of way, failing to provide proper warning, failing to provide a proper lookout, negligent operation of the vehicle, and distracted driving.

Bonds claims to have sustained physical injuries as a result of the collision. He is seeking damages in excess of $50,000 for pain, suffering, emotional distress, disfigurement, disability, loss of normal life, loss of earnings, loss of future earning capacity, and medical expenses, plus court costs and any other relief the court deems proper.
