Driver files negligence lawsuit claiming injury following rear-end collision on 63rd St. in Chicago

CHICAGO — A driver has has filed a lawsuit, claiming that he was injured when another driver rear-ended him on 63rd St. in Chicago.

According to a complaint filed in Cook County Circuit Court, on Jan. 18, 2022, plaintiff Matt Smith claims that he was driving eastward on 63rd St. in Chicago when defendant Joseph Shultz, who was driving in the same direction, suddenly collided into the rear of Smith's vehicle.

Shultz is accused of several acts of negligence, including operating his vehicle at an unreasonable speed, failing to maintain a proper lookout, following another vehicle too closely, failing to equip his vehicle with working brakes, neglecting to provide a proper audible warning, and failing to stop or change course to avoid imminent danger.

Smith claims to have sustained severe internal and external injuries due to this accident. He is seeking damages in excess of $50,000 for pain, suffering, mental anguish, loss of normal life, and medical expenses, plus court costs.

The plaintiff is represented by attorney David A. Rabinowitz of Dworkin & Maciariello in Chicago.
