The 2024 report provides an overview of the legal and regulatory issues that will impact managed care organizations in the coming months, and is a comprehensive resource for meeting compliance challenges, managing legal risks and adapting to technological changes. Managed Care Outlook 2024 addresses these key topic areas:

  • AI, technology and data privacy. MCOs face both opportunities and challenges stemming from the adoption of telehealth services, artificial intelligence and data analytics, as well as increasing use of tracking tools and health care websites.
  • Legal and regulatory. The evolving regulatory landscape includes increasing interstate post-Dobbs issues, state laws related to gender-affirming care, antitrust developments, payor transparency and increased congressional focus on False Claims Act collections.
  • Business and management. Compliance issues have evolved. Recent events have introduced uncertainty, and we’re seeing new kinds of litigation, areas of heightened scrutiny, and additional disclosure requirements for transactions and joint ventures.
  • Litigation and trends. MCOs and insurers face greater risks of litigation related to mental health parity, No Surprises Act and enforcement, bad faith claims, and the next wave of Medicare Advantage litigation.
Managed Care Outlook 2024 articles were authored by Reed Smith lawyers from multiple practices and industry groups, including Managed Care; Life Sciences Health Care Industry; Labor & Employment; Global Commercial Disputes; Insurance Recovery; Emerging Technologies; Entertainment & Media Industry; Environmental, Social & Governance; Energy & Natural Resources; Global Corporate; and Global Regulatory Enforcement.

“With more than 60 dedicated and experienced attorneys, our team continues to stay ahead of the potential legal risks and developing compliance challenges stemming from the evolving managed care landscape,” said Marty Bishop, leader of Reed Smith’s managed care practice. “The coming months will bring additional legal, regulatory, technological and policy changes on the federal and state levels, and along with it, more challenges for MCOs. Managed Care Outlook 2024 provides a valuable resource for MCO leaders, managers, and investors.”
