Retail pharmacy giant CVS has sued Redbox, saying the DVD rental company has refused to remove its kiosks from CVS stores, even though its contract has ended, and CVS has requested it do so.
According to the lawsuit, Redbox's contract stipulated that upon termination, the kiosks must be removed in a timely manner. However, CVS alleges that Redbox has not complied with this clause.
In addition to this, CVS is also seeking damages from Redbox for over $424,000 in allegedly unpaid commissions from these kiosks. The company is requesting both equitable relief and damages. CVS is asking for either an order of specific performance for the removal of the kiosks or permission to dispose of them as they see fit.
CVS is represented in the case by attorneys Kirstin B. Ives and Tyler G. Johannes, of Falkenberg Ives, of Chicago.
