Class action accuses Quaker Oats of failing to warn customers about salmonella risk on product labels

In the wake of a product recall for salmonella contamination, a class action lawsuit accuses Quaker Oats of improperly labeling its products by not warning customers of the possibility of salmonella exposure.

The lawsuit was filed on March 5 in Cook County Circuit Court by Hartence Hill on behalf of all affected customers. 

The company had issued product recalls on Dec. 15, 2023, and Jan. 11, 2024, due to salmonella contamination. The recalled products include various varieties of Quaker Chewy Bars, Quaker Puffed Granola Cereals, Frito-Lay Snacks Variety Pack with Quaker Chewy and Cap'n Crunch Treats Bars, among many others.

The lawsuit does not allege any of the plaintiffs may have been exposed to salmonella from Quaker Oats products. However, it asserts Quaker Oats allegedly violated a Connecticut state unfair trade practices law, as well as claims for breach of implied warranty and unjust enrichment.

The plaintiffs are seeking "litigation expenses," plus attorney fees. 

Plaintiffs are represented by attorney Phillip L. Fraietta, of New York.
