Class action targets online test prep biz Themis Bar Review over alleged tracking pixels

Online test preparation company, Themis Bar Review, is facing a class action lawsuit for allegedly allowing Facebook to access personal information about its customers through a tracking pixel. 

Named plaintiff, Sophia Sahagun, of Los Angeles, filed the suit on behalf of all persons with Facebook accounts who have purchased test preparation services from themisbar.com.

The complaint alleges that Chicago-based Themis Bar Review knowingly disclosed users' personally identifiable information (PII) and video viewing activity to Facebook without their consent. This was done using a code called the Facebook Tracking Pixel which tracks what videos users watch and then sends that data along with their PII to Facebook.

The sharing of this data without the consent of consumers constitutes a violation of the Video Privacy Protection Act and the California Invasion of Privacy Act, according to the lawsuit. According to the complaint, Sahagun enrolled for a bar preparation course on themisbar.com in September 2022 and discovered that her video watching activity and PII were shared with Facebook on 400 occasions.

Plaintiffs are asking the court to order Themis Bar Review to pay statutory damages and punitive damages, plus attorney fees.

The lawsuit was filed March 12 in federal court in Chicago.
