Anjali Das (Partner-Chicago, IL) and David Ross (Partner-Washington, DC) will present “Handling Data Breach Class Actions,” a Wilson Elser Forum webinar, on March 21, 2024. Acknowledging an increase in these cases, Anjali and David will cover the foundations of data breach class actions, providing common strategies in understanding and managing the cases. Topics include the typical allegations in these cases, factors to evaluate if cases are in federal or state court, core arguments for early dismissal motions, class certification strategies, individual and class settlement structuring, and key factors in handling, defending and settling the cases. They also will provide insurer representatives with a discussion of when and how breach response claim files often develop into data breach class actions, important considerations for retaining counsel to defend policyholders in these types of cases, and how insurer staffing guidelines should be addressed. Anjali and David also will discuss the frequency of mediation in data breach class actions, the participation in mediation by insurer representatives, and typical insurance-related disclosures before mediation and during discovery.
