Bogumila Lobrow sues Illinois Department of Labor, Belmont Groceries LLC and Richard Machnicki for unpaid wages and overtime claims

In a case filed in the Appellate Court of Illinois, First District (case ID: 1-23-0163) on March 11, 2024, plaintiff Bogumila Lobrow has lodged an appeal against defendants Illinois Department of Labor, Belmont Groceries LLC doing business as Rich's Fresh Market, and Richard Machnicki. The lawsuit pertains to unpaid wages and overtime claims that were previously dismissed by the Department of Labor.

Lobrow alleges that she is owed $64,500 in unpaid wages for work done between December 1, 2015, and February 5, 2017. This includes $60,000 in regular wages and $4,500 in overtime pay at an hourly rate of $25. She further argues that the circuit court erred by determining that an overtime claim dismissed by the Department in 2018 could not be raised on administrative review.

The plaintiff's claim was initially dismissed by an administrative law judge (ALJ) on January 6, 2021. However, this dismissal was vacated after Lobrow successfully argued that the Polish interpreter at her hearing was inaccurate. A new hearing with a different interpreter was set for October 12, 2021.

Lobrow seeks judgment affirming her claims for unpaid wages and overtime pay. She also requests the court to vacate its previous orders affirming the Department's decision and denying her motion to vacate.
