KJ Win sues KNB Motors for breach of contract over a commercial truck sale

In the Appellate Court of Illinois, First Judicial District, a case was filed by KJ Win, Inc. against KNB Motors, Inc., with the court case ID 1-23-0783 on April 5, 2024. The lawsuit is about a breach of contract where KJ Win alleges that KNB resold a commercial truck that had already been sold to them.

KJ Win, a California cargo shipment company, purchased a commercial truck from KNB Motors, an Illinois car dealership. Before KJ Win could pick up the truck from KNB, it was resold to another customer. The trial court found in favor of KJ Win and awarded it $20,129.12 in damages. However, KNB appealed against this judgment arguing various points including that the judgment was based on documents not admitted into evidence.

The plaintiff KJ Win sought specific performance of the contract along with compensatory and punitive damages for the breach of contract and fraud committed by KNB Motors. After pretrial proceedings and presenting five witnesses including Zhogjie Zhang who purchased the truck from KNB on behalf of KJ Win and three KNB employees, the trial court dismissed the fraud claim but upheld the breach of contract claim.
