Proxy Saunders sues Symphony Beverly for wrongful death and personal injury

In the Appellate Court of Illinois, First District, case number 1-23-0996 was filed by Proxy Saunders, as Independent Administrator for the Estate of Yvette Saunders, Deceased, against Symphony Beverly, LLC, Maestro Consulting Services, LLC, Lifeline Ambulance, LLC and several other defendants. The opinion was filed on April 8th, 2024.

The lawsuit involves claims for wrongful death and personal injury of the deceased Yvette Saunders. It alleges that prior to her death, Yvette suffered falls and infections while a resident at Symphony nursing home which ultimately led to her demise. Additionally, it claims that Lifeline Ambulance delayed in transporting her for medical treatment contributing to her injuries and death.

A settlement totaling $195,000 was approved by the trial court on August 18th, 2022 with Symphony paying $100,000; Lifeline Ambulance $40k; and Oak Lawn Respiratory and Rehabilitation Center $55k. However, this order did not adjudicate liens or determine attorney compensation or expenses.

The plaintiff is seeking entry of judgment costs and interest against two settling defendants - Symphony Beverly LLC and Lifeline Ambulance LLC. The trial court denied this motion reasoning that an order from the probate division approving a bond or other security required to administer the settlement and distribution was necessary before the defendants were required to tender settlement checks to the plaintiff.
