In the Circuit Court of Cook County, Illinois, plaintiff Mario Nisvis has filed a class action lawsuit against New City Moving LLC. The case, bearing ID 2024CH03174, was filed on April 12, 2024, and alleges violations of the Illinois Biometric Information Privacy Act (BIPA).

Nisvis, representing himself and other similarly situated individuals, accuses New City Moving of unlawful biometric scanning and storage practices. As past and present employees of the defendant company, the plaintiffs were required to provide their personalized biometric identifiers without being informed about where this data was stored or how long it would be kept.

The lawsuit further states that the defendant failed to comply with BIPA regulations which include notifying workers about biometric data collection and obtaining written consent for such practices. Nisvis seeks statutory damages and injunctive relief for these alleged violations.
