Christina Brayboy sues Advocate Health and Hospital Corporation for medical malpractice

In a case filed in the Appellate Court of Illinois, First District, Christina Brayboy, individually and as the Independent Administrator of the Estate of Benjamin Mathis, deceased, has lodged an appeal against Advocate Health and Hospital Corporation (d/b/a Advocate Good Samaritan Hospital). The court case ID is 2019 L 009806 and the judgment was delivered on March 28, 2024.

Brayboy brought her two young children to Advocate Good Samaritan Hospital after her three-year-old son, Benjamin Mathis, started showing flu-like symptoms. Despite being released from the hospital the following day, his condition worsened leading to his death due to an untreated bacterial infection. Brayboy then filed a medical malpractice lawsuit against Advocate Health and Hospital Corporation and defendants Dr. Michael Antoniolli and DuPage Emergency Physicians Ltd., alleging that her son's emergency room physician, Dr. Antoniolli was an actual and apparent agent of Advocate.

The plaintiff is seeking for a reversal of the circuit court's judgment which granted partial summary judgment in favor of Advocate on allegations of actual and apparent agency concerning Dr. Antoniolli's actions. Brayboy contends that there were genuine issues of material fact regarding her apparent agency claim.
