In the United States District Court for the Northern District of Illinois, plaintiff Brian Muniz has filed a lawsuit against Tricon Construction, LLC. The case (No. 3:24-cv-50146) was filed on April 17, 2024, and alleges violations of the Americans with Disabilities Act (ADA).

Brian Muniz, a resident of Illinois who uses a wheelchair for mobility purposes, claims that Tricon Construction's ADA violations have created significant barriers to entry for disabled persons like himself. The complaint details that in January 2023, Muniz was deterred from accessing a Pizza Hut property owned or operated by Tricon Construction located at 2524 S Alpine Rd, Rockford, IL 61108.

The plaintiff is seeking declaratory and injunctive relief requiring the defendant to remedy the identified violations and enact a policy ensuring proper maintenance of the property to avoid future ADA violations. The lawsuit argues that these actions are necessary to ensure equal access and enjoyment of public accommodations as mandated by Title III of the ADA.
