Brian Muniz sues Lunnon Properties for alleged violations of the Americans with Disabilities Act

In the United States District Court for the Northern District of Illinois, plaintiff Brian Muniz has filed a lawsuit against Lunnon Properties, LLC. The case ID is 3:24-cv-50152 and it was filed on April 18, 2024. The suit alleges that Lunnon Properties violated the Americans with Disabilities Act (ADA) by creating barriers to entry for disabled persons such as Muniz.

Muniz, who uses a wheelchair for mobility purposes, claims that he was deterred from accessing the shopping center owned by Lunnon Properties in December 2022. Despite attempts to resolve the matter prior to filing the complaint, no resolution was reached.

The plaintiff seeks declaratory and injunctive relief requiring Lunnon Properties to remedy the violations identified and enact a policy ensuring proper maintenance of the property to avoid future ADA violations. He also seeks an injunction correcting numerous ADA violations on the subject property.
