In the United States District Court, Northern District of Illinois, Dashaun Kennith Montgomery has filed a lawsuit against Trans Union LLC and Drive Casa, LLC. The case number is 1:24-cv-03078 and it was filed on April 17, 2024. The plaintiff alleges violations of the Fair Credit Reporting Act (FCRA) and demands a jury trial.
The plaintiff's counsel alleges that Trans Union and Drive Casa failed to ensure the accuracy of their consumer reports. Specifically, they argue that when Montgomery disputed information through these agencies, they did not conduct a reasonable investigation or correct inaccurate information. The damages sought include actual damages, statutory damages, punitive damages, costs, and attorney’s fees under the FCRA.
The plaintiff further alleges that he does not have an account with Drive Casa and never applied for one. However, in February 2024 he discovered a Drive Casa account appearing on his credit report. He reported this as identity theft to the Federal Trade Commission in March 2024 but found that the fraudulent account was still reported on his Trans Union credit report with a balance of $15,590.
Montgomery is seeking judgment against both defendants for their alleged failure to adhere to FCRA regulations. He is demanding actual damages for the harm suffered due to inaccurate reporting, statutory damages for each violation of the FCRA by each defendant, punitive damages to deter future misconduct by the defendants, as well as attorney's fees and costs.
