Rocio Lopez Cruz has filed a lawsuit against Villa Nail Salon & Spa, Inc. and Vinnie Nguyen in the United States District Court for the Northern District of Illinois. The case ID is 1:24-cv-03212 and it was filed on April 22, 2024. The plaintiff alleges that the defendants failed to pay her overtime wages as required by the Fair Labor Standards Act (FLSA) and the Illinois Minimum Wage Law (IMWL).
The plaintiff, represented by Becerra Law Group, LLC, claims she worked an average of 50 hours per week at the nail salon located at 9519 South Cicero Avenue in Oak Lawn, Illinois. However, she was not paid time and a half for all hours over 40 she worked for the defendants. Furthermore, she was classified as a 1099 independent contractor with no tax deductions taken from her wages.
During her employment period from March 2023 to April 17, 2024, Cruz reportedly asked her supervisor about overtime pay but was told that the defendants did not pay overtime. She was paid $14.00 per hour for every hour she worked for Defendants.
Cruz is seeking judgment against Villa Nail Salon & Spa, Inc. and Vinnie Nguyen for their alleged failure to pay overtime wages under FLSA and IMWL.
