In the United States District Court for the Northern District of Illinois, Eastern Division, Daniel J. Lynch has filed a class action complaint against Harris & Harris, Ltd. The case number is 1:24-cv-03510 and it was filed on April 30, 2024. The lawsuit accuses the defendant of violating the Telephone Consumer Protection Act (TCPA) and the Fair Debt Collection Practices Act (FDCPA).
Lynch, represented by his counsel, alleges that Harris & Harris, a prominent debt collection agency based in Chicago, continued to place harassing collection calls to his cellular phone despite his requests for them to cease. The plaintiff also claims that he received no less than fifty such calls and ten prerecorded voicemails after making his request. These actions took place after Lynch allegedly failed to make payments for medical services provided by Northwestern Medicine.
The plaintiff is seeking redress for these violations and alleges that the defendant's actions resulted in harassment, invasion of privacy, inconvenience, nuisance, and other harms associated with unsolicited automated calls. The plaintiff disputes owing the subject debt which Northwestern placed with the defendant for collection.
