John McMullen accuses SG360 of Age and Disability Discrimination

John McMullen has filed a lawsuit against The Segerdahl, LLC d/b/a SG360 in the United States District Court, Northern District of Illinois. The case, identified as 1:24-cv-03508, was filed on April 30, 2024. McMullen alleges age and disability discrimination and retaliation under the Age Discrimination in Employment Act of 1967 (ADEA) and the Americans with Disabilities Act of 1990 (ADA).

McMullen's counsel asserts that he experienced age-based harassment and retaliation for engaging in protected activity under ADEA. Additionally, he alleges that the defendant failed to accommodate his disability, engaged in disability-based harassment, and retaliated against him for participating in protected activity under ADA. McMullen worked as a Maintenance Manager for SG360 from November 2019 through February 2, 2024.

The plaintiff also claims that he was subjected to different terms and conditions of employment than others not within his protected classes. He further states that he experienced a hostile work environment due to his age and disability. At the time of these allegations, McMullen was 61 years old and suffered from type 2 diabetes.

McMullen is seeking redress for the alleged discrimination based on his age and disability as well as the claimed retaliation by SG360. He had previously filed a charge of employment discrimination with the Equal Employment Opportunity Commission (EEOC) and received a Notice of Right to Sue.
