Antonio McKinley has filed a lawsuit against the City of Chicago and Chicago Police Officers Francisco Morado and Antonio Ocampo in the United States District Court for the Northern District of Illinois, under case number 24-cv-3465, on April 30, 2024. The plaintiff is represented by the Law Office of Jordan Marsh LLC. The complaint arises from alleged violations of the Constitution of the United States, particularly the Eighth and Fourteenth Amendments, as well as the Civil Rights Act.

On January 21, 2023, McKinley was arrested by officers Morado and Ocampo while walking on North Ridgeway Avenue in Chicago. Despite finding no drugs on McKinley during a search, he was accused of engaging in hand-to-hand drug transactions. Following his arrest, McKinley was detained at Cook County Jail until February 5, 2023.

McKinley faced charges of manufacture and/or delivery of Fentanyl - a Class X Felony - and possession of over 15 grams of Heroin - a Class 1 felony. He was offered a plea deal to plead guilty to the heroin charge in exchange for dismissal of the fentanyl charge but declined despite potential severe sentencing if found guilty.
