Man accuses Cushing Transportation of Failing to Pay Overtime Wages

In the United States District Court for the Northern District of Illinois, Eastern Division, plaintiff Michael Prachasitthisak has filed a lawsuit against Cushing Transportation, Inc. The case, identified as 1:24-cv-03840 and filed on May 10, 2024, alleges that the defendant failed to pay overtime wages in violation of federal and state labor laws.

Represented by The Garfinkel Group, LLC, Prachasitthisak claims that he was not paid for hours worked beyond the standard 40-hour workweek. He served as a Night Dispatcher for Cushing Transportation from October 2019 to March 2024. Despite often working more than his regular schedule of 53 hours per week and occasionally being required to work 12-hour shifts on weekends, he was paid at a straight rate of $25 per hour without any overtime compensation.

The plaintiff seeks judgment for unpaid overtime wages under the Fair Labor Standards Act (FLSA), the Illinois Minimum Wage Law (IMWL), and the Cook County Minimum Wage Ordinance (CCMWO). He alleges that Cushing Transportation intentionally violated these laws and failed to maintain any record of his hours worked.
