Holger Fiallo has filed a lawsuit against Land of A Thousand Hills Coffee Shop, LLC in the United States District Court for the Northern District of Illinois. The case, identified as 1:24-cv-03688, was lodged on May 6, 2024. The plaintiff alleges that the defendant's digital properties are not accessible to visually impaired individuals, violating Title III of the Americans with Disabilities Act (ADA).

Fiallo, represented by his counsel, asserts that approximately 2.3% of the American population lives with some visual disability. He argues that access to digital platforms has become critical for this significant portion of Americans, especially post-pandemic. He further points out that e-commerce has grown substantially since 2020, underscoring the importance of online accessibility.

The plaintiff seeks a permanent injunction requiring Land of A Thousand Hills Coffee Shop to modify its corporate policies to ensure its digital properties are accessible and remain so for individuals with visual disabilities. This would involve adapting their digital content to be universally accessible and ensuring effective communication for legally blind individuals.
