Plaintiffs accuse USAA Federal Savings Bank of unauthorized transactions

In the United States District Court, Northern District of Illinois, plaintiffs Roberta Niche and Elizabeth Younkie have filed a lawsuit against USAA Federal Savings Bank. The case, identified as 1:24-cv-03692, was filed on May 7, 2024. The complaint alleges unauthorized transactions from their accounts held with the defendant.

The court filing details that between June 21 and June 27, 2023, an unknown perpetrator unlawfully accessed Ms. Niche's bank accounts and created new fraudulent ones. A total of $25,000 was transferred from Ms. Niche's account and the plaintiffs' joint account to these fraudulent accounts. However, some funds were returned to the joint account in late June 2023.

Despite this return of funds, the plaintiffs allege they are still owed $22,513.95 by USAA Bank. They claim they promptly disputed the transactions with supporting documentation but were repeatedly denied by the defendant.

The plaintiffs are seeking judgment for violations of the Electronic Funds Transfer Act and for conversion. They are demanding reimbursement for the stolen funds which they argue is consistent with their banking history and prior account usage.
