**Premature Infant's Family Sues Mead Johnson for Injuries from Cow’s Milk-Based Formula**
In the United States District Court for the Northern District of Illinois, Chicago Division, case number 1:24-cv-03858 was filed on May 13, 2024. Plaintiff Teddi House, individually and as parent and next friend of Nevaiah Mayle, a minor, is suing defendants Mead Johnson & Company, LLC and Mead Johnson Nutrition Company. The lawsuit centers around injuries suffered by Baby Nevaiah Mayle after being fed cow’s milk-based infant formula produced by the defendants.
According to the filing, Baby Mayle was born prematurely at Aultman Hospital in Canton, Ohio on May 20, 2006. After being fed Enfamil HMF 24 starting on May 29, 2006, Baby Mayle developed Necrotizing Enterocolitis (NEC), a severe intestinal disease. On June 11, 2006, due to worsening symptoms including bloody stools and abdominal distention, Baby Mayle underwent surgery at Akron Children’s Hospital where necrosis of the small bowel and perforated transverse colon were discovered.
Plaintiff's counsel includes James E. Douglas Jr. and C. Andrew Childers from Childers, Schlueter & Smith LLC. The complaint alleges that Mead Johnson negligently marketed their cow’s milk-based products as safe for preterm infants despite knowing the significant risks of NEC associated with such products. The plaintiff seeks damages exceeding $75,000 for medical expenses and other claims related to Baby Mayle's injuries.
The plaintiff is seeking judgment against Mead Johnson for general and compensatory damages as well as punitive damages under Ohio Revised Code 2315 et al., and other applicable laws. Additionally, they request a trial by jury.
