Digital Media Company Sues Fast-Food Chain Over Unpaid Advertising Services

A prominent digital media company has filed a lawsuit against a well-known fast-food chain, alleging unpaid advertising and marketing services amounting to over $95,000. Townsquare Media Rockford LLC lodged the complaint in the United States District Court for the Northern District of Illinois on July 9, 2024, targeting Beef-A-Roo, Inc.

According to the court documents, Townsquare Media Rockford LLC is a Delaware limited liability company whose members are Steven Price and Stuart Rosenstein from Florida and Claire Yenicay from New York. The defendant, Beef-A-Roo, Inc., is an Illinois corporation with its principal place of business in Rockford, Illinois. The case falls under federal jurisdiction due to the diversity of citizenship between the parties and the amount in controversy exceeding $75,000.

The plaintiff claims that between 2023 and 2024, they were contracted by Beef-A-Roo to provide various advertising and marketing services as part of the restaurant's expansion efforts. These services were rendered promptly and satisfactorily. However, despite repeated demands for payment, Beef-A-Roo allegedly failed to settle outstanding invoices totaling $95,410.84 by April 23, 2024. The plaintiff provided detailed records of these transactions in their filing.

Townsquare Media Rockford LLC argues that this failure constitutes a breach of contract. They cite specific terms within their agreements stipulating that payments were due within thirty days of invoicing and subject to interest if unpaid within that period. As per these terms: "Any undisputed amounts not paid within thirty (30) days of receipt of invoice shall accrue interest at a rate of one (1%) percent per month or the maximum lawful rate." The plaintiff is seeking judgment for the outstanding balance plus interest accrued, attorneys' fees, costs incurred during litigation, and any other damages deemed appropriate by the court.

In addition to breach of contract claims, Townsquare Media Rockford LLC also asserts unjust enrichment in an alternative count. They argue that Beef-A-Roo benefited from their services without providing reasonable compensation despite acknowledging and utilizing those benefits.
