Former Dock Worker Alleges Age & Sex Discrimination Against Employers

A former dock worker has filed a lawsuit against her employers, alleging age and sex discrimination, harassment, and retaliation. Trina Mobley filed the complaint in the United States District Court for the Northern District of Illinois on August 27, 2024, against Quiet Logistics, Inc., and Insperity PEO Services, L.P.

Mobley's lawsuit arises under the Age Discrimination in Employment Act of 1967 (ADEA) and Title VII of the Civil Rights Act of 1964. She claims that during her employment from April 2021 to November 12, 2023, she was subjected to different terms and conditions than her younger and male colleagues. According to Mobley, this treatment created a hostile work environment based on both age and sex. The plaintiff is seeking redress for what she describes as age-based harassment and retaliation for engaging in protected activities under these laws.

In her complaint, Mobley details several incidents that contributed to her claims. On October 7, 2023, she sent an email to Human Resources expressing discomfort about working in an environment rife with sexual harassment. She described male coworkers walking around with their pants sagging low enough to expose their backsides and even their genitals. After reporting this behavior, Mobley experienced ostracism from her peers for two weeks. On October 25, 2023, another incident occurred involving a coworker named Cornelius who verbally harassed her while she was performing tasks meant for five individuals. Despite filing complaints with HR about these incidents and stating that she believed she was being targeted due to her age and sex, no action was taken against Cornelius or other perpetrators.

Mobley alleges that following her complaints about discrimination and harassment based on age and sex, she was unlawfully terminated on November 12, 2023. Her duties were subsequently assigned to younger male employees despite her strong performance throughout her tenure at the company. She asserts that her termination was a direct result of retaliation for opposing unlawful discrimination and exercising her protected rights under ADEA and Title VII.

The plaintiff is seeking various forms of relief from the court including back pay with interest, front pay, loss of benefits, compensatory and punitive damages, reasonable attorneys' fees and costs, pre-judgment interest if applicable, as well as any other relief deemed just by the court.
