Class action accuses Napleton Automotive of running consumer credit reports without authorization

A class action lawsuit has accused the Ed Napleton Automotive dealerships of allegedly running consumers' credit without their consent or knowledge, allegedly in violation of federal law. 

The lawsuit was filed against Napleton Enterprises, LLC, North American Automotive Services, Inc., and Napleton's Arlington Heights Motors Inc. in Cook County Circuit Court.

The suit accuses these entities of illegally accessing consumer credit reports without consent, in violation of the Fair Credit Reporting Act (FCRA). 

Named plaintiff Brian Olsen claims that his credit report was accessed without authorization when he visited a dealership to consider a cash purchase. 

The lawsuit seeks class-wide relief for similar violations experienced by other consumers. 

The lawsuit was removed to federal court by the defendants on September 25. 

The plaintiffs are represented by attorney Jordan M. Sartell and others with the firm of Francis Mailmain Soumilas, of Wheaton.
