A class action lawsuit has accused the Turano Baking Company of allegedly wrongly asking job applicants about their personal and family medical history, allegedly in violation of Illinois' genetic information privacy law.
The lawsuit was filed against Campagna-Turano Bakery, Inc., operating as Turano Baking Co., by plaintiff Julio Lozano.
The suit alleges that the company violated the Illinois Genetic Information Privacy Act (GIPA) by improperly soliciting genetic information from job applicants, specifically family medical history, during pre-employment physical examinations.
The complaint claims that this practice breaches privacy rights protected under GIPA and seeks statutory damages for affected individuals.
The case was filed in Cook County Circuit Court, but was removed to federal court by the defendants on Sept. 25.
Plaintiffs are represented by attorney Andrew Heldut and others from the firm of McGuire Law P.C., of Chicago.
