Lovitedo LLC accuses foreign entities operating online marketplaces of patent infringement

Lovitedo, LLC has taken legal action against a group of unidentified foreign entities accused of infringing on its patent rights. On October 8, 2024, Lovitedo, LLC filed a complaint in the United States District Court for the Northern District of Illinois against these unnamed defendants. The company alleges that these defendants are selling counterfeit products online that violate Lovitedo's intellectual property rights.

The lawsuit centers around United States Patent Number 11,644,271, which Lovitedo claims to be the exclusive licensee of. According to the complaint, the defendants are operating under aliases and conducting their business through interactive commercial websites hosted on platforms like Amazon.com. These sites target consumers in the United States and have allegedly sold counterfeit versions of Lovitedo's patented products to unsuspecting buyers in Illinois and beyond. The complaint accuses the defendants of being an interrelated group of counterfeiters who work together to manufacture, import, distribute, and sell these infringing products without authorization.

Lovitedo asserts that this infringement is not only deliberate but also part of a larger scheme involving multiple fictitious identities and addresses used by the defendants to conceal their operations. The company highlights that despite their efforts to hide their true identities, there are notable similarities among the defendant internet stores suggesting a common source or manufacturer based in China. This alleged counterfeiting operation is said to cause significant harm to Lovitedo's business reputation and financial standing.

In response to these allegations, Lovitedo seeks several forms of relief from the court. They request preliminary and permanent injunctions against the defendants to prevent further sales of counterfeit products. Additionally, they seek damages for lost profits due to infringement as well as enhanced damages for willful violations under U.S. patent law. The plaintiff also asks for an expungement of illicit funds gained from these activities and requests attorney fees and costs associated with pursuing this legal action.
