Plaintiff Alleges Discrimination Against Former Employer Crescent Cleaning Company Under ADA

A former employee is taking legal action against a cleaning company, alleging a series of discriminatory practices and wrongful termination. Christopher Sader filed the complaint on October 15, 2024, in the United States District Court for the Northern District of Illinois against Hamill Partners, Inc., doing business as Crescent Cleaning Company. The lawsuit claims violations under the Americans with Disabilities Act (ADA) and the Civil Rights Act of 1964.

Christopher Sader's lawsuit details his experiences working as a custodian for Crescent Cleaning Company starting July 7, 2024. Sader, who has a heart condition requiring regular medical appointments, alleges that his employer failed to accommodate his disability and subjected him to harassment and discrimination based on both his disability and race. He recounts an incident where his request for time off to attend a medical appointment was met with resistance from Laura, the district manager. "I thought you were going in September?" she allegedly remarked when he sought permission to leave work early for medical reasons. Fearing retaliation, Sader canceled necessary medical appointments.

Sader further accuses Crescent Cleaning Company of creating a hostile work environment by treating him differently from Hispanic employees and terminating him unjustly on August 12, 2024—the same day he requested time off for medical purposes. Despite receiving positive feedback from Denise, the property manager, regarding his job performance, Sader was told by Laura that he failed "a test" during his probationary period. He contends that similarly situated Hispanic employees were not disciplined or terminated for similar performance levels.

The complaint outlines multiple counts against Crescent Cleaning Company: disability-based discrimination and failure to accommodate under the ADA; retaliation for engaging in protected activities; race-based discrimination under both Section 1981 and Title VII of the Civil Rights Act of 1964. Sader argues that these actions have caused him significant emotional distress and financial loss due to unemployment.

In seeking justice, Christopher Sader requests various forms of relief from the court including back pay with interest, front pay, compensatory and punitive damages, loss of benefits compensation, reasonable attorney fees and costs, along with any other relief deemed appropriate by the court.
