Kilcoy Global Foods Accuses Selza Entities and Mr. Meat Master of Breach of Contract Over Unpaid Invoices

In a significant legal battle that could impact business dealings across state lines, Kilcoy Global Foods has filed a lawsuit against Selza International Inc., Selza International LLC, Mr. Meat Master Inc., and Rafael Hernandez for breach of contract and unjust enrichment. The complaint was lodged in the United States District Court for the Northern District of Illinois on December 19, 2024, targeting the defendants for failing to pay over $736,000 for meat products delivered earlier this year.

Kilcoy Global Foods, represented by attorneys Charles A. DeVore and Leigh A. Brissenden from Katten Muchin Rosenman LLP, claims that in May 2023, they entered into a Credit Application and Agreement with Selza International Inc., establishing terms for supplying premium meat products. However, despite receiving goods worth $736,129.37 between April and May 2024—comprising approximately 122,000 pounds of Grain-Fed Inside Skirt Steak and about 40,000 pounds of Beef Tripe—the defendants have allegedly failed to make any payments. Kilcoy contends that these products were accepted and likely resold by the defendants without settling the invoices issued within seven days as per their agreement.

The plaintiff asserts that since May 2024, multiple attempts to resolve the issue amicably have been met with evasive tactics from the defendants. These include misrepresentations regarding payment timelines and claims of financial difficulties despite Mr. Meat Master Inc.'s reported revenues of $8 million mid-year and projected earnings of $23 million for 2024 during a crowdfunding campaign. Consequently, Kilcoy has filed this lawsuit citing breach of contract against all involved parties: Selza Defendants (Selza International Inc. and LLC), Mr. Meat Master Inc., and Rafael Hernandez individually.

Kilcoy seeks damages amounting to at least $736,129.37 plus late fees as stipulated in their credit agreement along with attorney’s fees incurred due to this legal action. They also demand restitution based on unjust enrichment principles since the defendants have retained economic benefits from reselling goods without compensating Kilcoy.

The case is presided over by judges from the Northern District of Illinois under Case ID: 1:24-cv-13072. Attorneys Charles A. DeVore and Leigh A. Brissenden represent Kilcoy Global Foods in this matter.
