Plaintiff accuses major insurer of illegally collecting consumer driving data

A class action lawsuit has been filed against a major insurance corporation, accusing it of unlawfully collecting and selling consumers' driving behavior data. The complaint was filed by Kimberleigh Duffield in the United States District Court for the Northern District of Illinois on January 17, 2025, targeting The Allstate Corporation and its subsidiaries.

According to the complaint, Duffield alleges that Allstate conspired to secretly collect "trillions of miles" worth of driving data from millions of Americans without their consent. This data was reportedly gathered through mobile devices and integrated into third-party applications using software developed by Allstate's subsidiary, Arity LLC. The collected information includes sensitive details such as geolocation, speed, and driving habits. Duffield claims that this massive database was created not only to support Allstate's insurance business but also to sell this valuable information to other insurers for profit.

The lawsuit highlights that consumers were neither informed nor gave consent for their data to be collected or sold. The complaint further accuses Allstate of incentivizing app developers with financial rewards to integrate their data-collecting software into various apps, allowing them real-time access to users' locations and movements. It is alleged that this practice violates several state and federal laws, including the Federal Wiretap Act and the Stored Communications Act.

Duffield asserts that as a result of these actions, she has experienced increased insurance premiums despite having a clean driving record. She argues that her privacy has been violated in multiple ways due to Allstate's unauthorized use of her personal data. On behalf of herself and others similarly affected, Duffield seeks damages for losses incurred due to these practices and requests injunctive relief to prevent future occurrences.
