Plaintiff alleges ambulance service company violated wage laws

Matthew Davidson has filed a class and collective action lawsuit against Superior Air-Ground Ambulance Service, Inc., alleging violations of wage laws. The complaint was filed on February 19, 2025, in the United States District Court for the Northern District of Illinois. Davidson accuses Superior of failing to pay him and other hourly employees proper overtime wages as required by the Fair Labor Standards Act (FLSA) and Illinois Minimum Wage Law (IMWL).

Davidson worked as a paramedic for Superior from August 2021 to November 2023. He claims that he and other hourly employees regularly worked more than 40 hours per week but were not compensated at the required overtime rate of 1.5 times their regular pay. Instead, Superior allegedly paid non-discretionary bonuses without including them in the calculation of overtime rates, which Davidson argues is a violation of both federal and state wage laws. "Superior's bonus pay scheme violates the Fair Labor Standards Act (FLSA) and Illinois Minimum Wage Law (IMWL)," states the complaint.

The lawsuit seeks to represent all similarly situated hourly employees who were subject to this alleged bonus pay scheme over the past three years. Davidson aims to recover unpaid wages, liquidated damages, treble damages under state law, statutory penalties, attorneys' fees, and other costs associated with bringing this action. The complaint highlights that Superior has been previously sued for similar wage violations, suggesting a pattern of non-compliance with labor laws.
