In a landmark legal battle highlighting the ongoing struggle for digital accessibility, a visually-impaired plaintiff has taken legal action against a supplement company for allegedly failing to make its website accessible to blind and visually-impaired users. Constance Henry filed the complaint in the United States District Court for the Northern District of Illinois on February 28, 2025, accusing Revive Md Supplement Company LLC of violating the Americans with Disabilities Act (ADA).

The lawsuit alleges that Revive Md Supplement Company's website, Revivesups.com, is not designed to be fully accessible to individuals who rely on screen-reading software due to visual impairments. According to the complaint, this lack of accessibility denies blind and visually-impaired individuals equal access to the goods and services offered by the company. The plaintiff contends that despite available technology and established guidelines like WCAG 2.2, which provide standards for web accessibility, Revive Md Supplement Company has chosen an exclusively visual interface that excludes those with disabilities.

Constance Henry's personal experience serves as a central narrative in this case. As someone who uses screen-reading software to navigate online spaces, she attempted to purchase health supplements from Revivesups.com but encountered numerous barriers that prevented her from completing a transaction independently. The complaint details specific issues such as missing alternative text for images, improper heading hierarchy, and forms that cannot be completed without a mouse—features essential for accessibility yet absent from the site.

The lawsuit seeks not only compensatory damages but also demands significant changes in how Revive Md Supplement Company operates its online platform. The plaintiff requests a permanent injunction requiring the company to modify its website policies and practices so it becomes accessible to all users regardless of their visual abilities. This includes implementing features like alternative text for images and ensuring keyboard navigability without reliance on a mouse.

Represented by David B. Reyes of Equal Access Law Group PLLC, Constance Henry's case underscores broader issues regarding digital inclusivity and compliance with federal laws designed to protect individuals with disabilities. The case is being overseen by judges at the Northern District of Illinois under Case No.: 1:25-cv-2094.
