Constance Henry filed a class-action complaint on February 28, 2025, in the United States District Court for the Northern District of Illinois against Approved Science LLC. The lawsuit accuses the company of violating the Americans with Disabilities Act (ADA) by failing to make its website accessible to individuals who are blind or visually impaired.
Henry, who resides in Will County, Illinois, and is legally blind, relies on screen-reading software to access online content. She argues that Approved Science's website, approvedscience.com, is not designed to accommodate such technology, effectively excluding her and others from purchasing products independently. According to Henry's complaint, "Defendant’s denial of full and equal access to its website...is a violation of Plaintiff’s rights under the Americans with Disabilities Act."
The complaint highlights several accessibility barriers on the website that prevent blind users from navigating it effectively. These include inadequate alternative text for images, unclear form field labels, and reliance on mouse navigation rather than keyboard commands. Such issues make it impossible for visually impaired customers like Henry to complete transactions without assistance. The lawsuit emphasizes that despite readily available technology solutions used by other retailers to ensure web accessibility, Approved Science has failed to implement these measures.
Henry seeks a permanent injunction requiring Approved Science to modify its website policies and practices so that it becomes fully accessible to blind consumers. Additionally, she demands compensatory damages for herself and others affected by what she describes as unlawful discrimination under the ADA. The case also calls for declaratory relief affirming that Approved Science's current web practices violate federal law.
