The complaint was filed by Michael Alfaro on March 12, 2025, in the United States District Court for the Northern District of Illinois against Valentin Marian, Inga Marian, and Hunzinger Williams, Inc.
Michael Alfaro claims that during his employment with Hunzinger Williams Inc., he was not paid for several weeks of work. This lawsuit arises under multiple labor laws including the Fair Labor Standards Act (FLSA), the Illinois Minimum Wage Law (IMWL), and the Illinois Wage Payment and Collection Act (IWPCA). According to Alfaro's complaint, he performed landscaping work during the 2024 season but was denied due compensation. "Defendants failed to pay Plaintiff for several weeks," reads a part of the filing. Despite being issued paychecks, Alfaro alleges that he was instructed not to cash them until business improved—a promise that ultimately went unfulfilled when checks were returned due to insufficient funds.
The defendants are accused of willfully violating labor laws by refusing to pay minimum wages for all hours worked. As per Alfaro's allegations, both Valentin and Inga Marian were actively involved in managing Hunzinger Williams Inc., holding authority over hiring decisions and financial operations including payroll. The complaint further details how these actions have affected other employees similarly situated who also did not receive proper compensation.
Alfaro is seeking judgment against the defendants for unpaid wages dating back three years prior to filing this suit. He demands liquidated damages equal to unpaid wages under FLSA provisions along with pre- and post-judgment interest at statutory rates. Additionally, treble damages are sought under IMWL for unpaid wages alongside penalties amounting to five percent per month of underpayment duration.
