A former senior executive has filed a lawsuit against a major health corporation, alleging multiple counts of discrimination and retaliation. David Hummel initiated the complaint on March 27, 2025, in the United States District Court for the Northern District of Illinois against CVS Health, Caremark L.L.C., and CVS Pharmacy, Inc.
The lawsuit outlines Hummel's allegations that during his tenure at CVS, he was subjected to gender/sex discrimination, race/color discrimination, age discrimination, and retaliation—all in violation of Title VII of the Civil Rights Act, the Illinois Human Rights Act (IHRA), and the Age Discrimination in Employment Act (ADEA). Hummel claims that despite receiving consistent praise for his performance and leadership qualities over several years—having been promoted to Vice President of Client Implementation and Services—he was unlawfully terminated on June 27, 2024. The plaintiff argues that this termination was based on false accusations that he treated female employees less favorably than males and failed to report gender discrimination concerns. These reasons were described as "false and pretextual" by Hummel.
Hummel asserts that his termination followed a series of internal complaints he made against his supervisor for sexual harassment and discriminatory practices. Instead of addressing these issues, Hummel alleges that CVS retaliated against him by terminating his employment. He further claims that after his dismissal, he was replaced by someone younger or female with lesser qualifications. This alleged discriminatory act has led to significant financial losses for Hummel, including lost wages exceeding $3 million.
In response to these grievances, Hummel is seeking reinstatement to his former position along with back pay for lost wages and benefits. He also demands damages for emotional distress and humiliation totaling more than $3 million. Additionally, Hummel requests an injunction against CVS to prevent further discriminatory practices and mandates training programs within the company to promote equal employment opportunities.
