Estate Executor Alleges Negligence Against Assisted Living Facility Over Resident's Death

Adam Peri, acting as the Independent Executor of Joyce Ferdinand's estate, has filed a compelling lawsuit against the Council for Jewish Elderly, doing business as Weinberg Community for Senior Living. The complaint was lodged on April 7, 2025, in the Circuit Court of Cook County, Illinois. It accuses the defendant of negligence and failure to provide adequate care to Joyce Ferdinand during her residency at their facility.

The case centers around allegations that from July 20, 2023, through October 27, 2023, Joyce Ferdinand was a resident at the Friend Center for Memory Care. During this time, it is claimed that the facility failed in its duty to provide appropriate care and supervision. According to the complaint filed by Adam Peri through his attorneys at The Rooth Law Firm, these failures included negligently accepting Ms. Ferdinand as a resident without ensuring they could meet her needs and failing to transfer her to a more suitable facility capable of providing necessary care.

Joyce Ferdinand reportedly suffered severe health consequences due to these alleged lapses in care. She developed skin breakdowns leading to an abscess and infection that required extended hospitalization. Furthermore, it is claimed that these injuries resulted in significant physical and emotional suffering for Ms. Ferdinand before her death on October 12, 2024.

The plaintiff asserts that these negligent acts or omissions directly contributed to Ms. Ferdinand's injuries and eventual death. As such, they are seeking damages exceeding $50,000 along with costs related to the lawsuit and prejudgment interest. This legal action is pursued under both the Illinois Survival Act and the Illinois Wrongful Death Act.

In addition to financial compensation for medical expenses incurred due to inadequate care provided by Weinberg Community for Senior Living, Adam Peri seeks justice for the emotional distress experienced by Ms. Ferdinand's next-of-kin—her grandsons Adam Peri Jr., Jeffrey Ferdinand, Douglas Ferdinand, and Gregory Ferdinand—who have endured profound grief following her passing.

Representing Adam Peri in this case is attorney Robert J. Rooth from The Rooth Law Firm based in Evanston, Illinois. The firm argues that there exists substantial evidence supporting claims against Weinberg Community for Senior Living regarding their failure in meeting acceptable standards of care expected from assisted living facilities handling residents with complex medical histories like Ms. Ferdinand’s.

The lawsuit also includes an affidavit confirming consultation with a qualified health professional who reviewed relevant medical records pertaining to this case—a requirement under Section 5/2-622 of the Illinois Code of Civil Procedure—to establish reasonable grounds for pursuing legal action against Weinberg Community for Senior Living.
