The defendants named include Walsh Construction Company II, LLC; Herzog Technologies Inc.; Herzog Railroad Services Inc.; Herzog Contracting Corp; and Modern Railway Systems (Inc.), among others. These entities are accused of failing to provide a safe working environment by neglecting proper inspection and maintenance duties.
According to the lawsuit, Madigan was employed by John Burns Construction and was injured while performing his duties on-site. The complaint details how the defendants allegedly failed in their responsibilities: "Failed to make a reasonable inspection of the premises... Failed to warn the Plaintiff of the dangerous condition... Pushed and rushed the job which compromised safety." These actions are claimed to have directly resulted in Madigan's injuries when he tripped and fell due to inadequate ground conditions between an FOT house and his truck.
Madigan seeks judgment for damages sufficient to meet the jurisdictional limits of the court and additional compensation as deemed appropriate by a jury.
