The complaint details how Veselinovich allegedly misled potential buyers by providing a Real Estate Property Disclosure Report that falsely stated he was unaware of any material defects in the basement or foundation. The Wills relied on this disclosure when they agreed to purchase the property for $662,500 on March 10, 2024. However, after taking possession on April 10, 2024, they experienced severe water damage due to foundation issues previously hidden by walls constructed over defective areas.

The plaintiffs accuse Veselinovich of violating the Illinois Residential Property Disclosure Act (765 ILCS 77/1 et seq.) by failing to disclose known defects. They also charge him with fraudulent concealment for deliberately hiding these issues to facilitate the sale. As a result of these alleged actions, Nathan and Kendall Wille claim damages exceeding $50,000 due to repairs and personal property damage caused by water intrusion.

In their lawsuit, the Wills seek compensatory and punitive damages from Veselinovich. They request an amount exceeding the jurisdictional limits of the Cook County Law Division along with prejudgment interest, costs associated with legal proceedings, and reasonable attorney fees as stipulated under state law (765 ILCS 77/55).
